Terms and Conditions
- Definitions
Customer: means (1) all customers who have a Tata Indicom Wi-Fi Service account or a Tata Indicom Total Internet account or a Tata Indicom Broadband account and/or (2) all customers of partners / other service providers with whom Tata Communications has any kind of tie up / alliance / agreement.
Tata Indicom Wi-Fi Service: means (1)Tata Indicom Wi-Fi Service as offered to Tata Communications customers / customers of Roaming partners in India and /or (2) Roaming Wi-Fi Service: means the Wi-Fi service offered by any partner / service provider with whom Tata Communications has any kind of tie up / alliance / agreement.
- As a customer, you must
2.1. use the Wi-Fi service in accordance with the Terms of Use.
2.2. use a valid account to access Wi-Fi service.
- As a customer, you must not:
3.1. use the Tata Indicom Wi-Fi Service for any activities, or transmit via the Tata Indicom Wi-Fi Service; any information or materials, which breach any laws or regulations, infringe a third party's rights or privacy, or are contrary to any relevant standards or codes
3.2. use Tata Indicom Wi-Fi Service in a way, to transmit any material, which interferes with other users or defames, harasses, threatens, menaces or offends any person or which inhibits any other customer from using or enjoying Tata Indicom Wi-Fi Service
3.3. use Tata Indicom Wi-Fi Service to send unsolicited commercial or bulk electronic mail messages to anyone
3.4. make any fraudulent or speculative enquiries, bookings, reservations or requests using Tata Indicom Wi-Fi Service
3.5. use any other customer’s credentials without his permission
3.6. impersonate another person when logging in to Tata Indicom Wi-Fi Service
3.7. transmit via Tata Indicom Wi-Fi Service any obscene, indecent, inflammatory or pornographic material or material that could give rise to civil or criminal proceedings
3.8. resort to hacking or destroying the Internet sites including the websites of Tata Indicom or Tata Communications
3.9. attempt any of the above acts or permit another person to do any of the above acts
- Third Party Content & Promotions
4.1. Tata Indicom Wi-Fi Service welcome page features advertisements and promotions of third parties. Where it is apparent that products, services and information are not provided by Tata Communications, then the customer’s legal relationship in respect of those products, services and that information shall be with such third party supplier to whom the product belongs.
4.2. Tata Communications Internet Services Limited does not check or warrant the accuracy or completeness of the information or the suitability or quality of the products and services of the third parties. Customer must make their own enquiries with the relevant third party supplier directly before relying on the third party information or entering into a transaction in relation to the third party products and services supplied via Tata Indicom Wi-Fi Service . Customer should agree to the ‘terms and conditions’ laid down by such third party.
4.3. Tata Communications Internet Services Limited may receive fees and/or commissions from third parties for goods and services of such third parties displayed or made available on Tata Indicom Wi-Fi Service landing page or website or accessible through a hyperlink on any of the above.
4.4. If you are using a promotional plan, then specific promotional terms and conditions may apply.
- Tariff Change
5.1 The tariffs charged for using Tata Indicom Wi-Fi Service are subject to change without prior notice. Customer must check the tariffs before using Tata Indicom Wi-Fi Service.
- Security
6.1. For security reasons we may require the customer to re-authenticate himself from time to time, for example after a period of inactivity on the connection between his browser and the Tata Indicom Wi-Fi Service servers. Tata Communications does not take any responsibility for any information that the customer may lose if the customer session is terminated due to prolonged periods of inactivity between his browser and the Tata Indicom Wi-Fi Service servers.
6.2. Customer must comply with all directions issued by Tata Communications or our partners relating to use of service. Neither Tata Communications nor any of Tata Communications’s partners are responsible for providing neither the computer, hardware, software nor any other equipment necessary to access the Internet.
6.3. Customer must not send or disclose his ‘Password / PIN’ to any other person or store it in a manner that would reasonably allow another person or entity to obtain access to it and Tata Communications shall not be responsible for the same.
6.4. Customer must not keep the ‘Password / PIN’ in a location where it is capable of being copied or used by any other person or disclose it to any other person. Tata Communications will not be responsible if your password is copied and used for accessing Tata Indicom Wi-Fi services. No amount shall be refunded due to loss of card or password.
6.5. Tata Communications is entitled to rely on the information provided by customer during online purchase of a serial no. by using a credit card. Tata Communications cannot and does not verify that the person who has purchased the card online is the owner of that credit card, which he used to buy the serial no.
6.6. Customer must immediately notify us if he becomes aware:
6.6.1. that his serial no. and password is known by a third party (other than by an Authorised Person); or
6.6.2. of any unauthorised use of his password
In the event that customer notifies Tata Communications as above, we will take reasonable steps to change the password for that customer.
6.7 Tata Communications will take reasonable steps to secure Tata Indicom Wi-Fi Service and the systems in its control that are used to access Tata Indicom Wi-Fi Service. However, the Internet is sometimes unreliable and is a difficult medium to secure. Tata Communications therefore does not guarantee the security of Tata Indicom Wi-Fi or the systems (including the Internet and your hardware and software) used to access Tata Indicom Wi-Fi , or any information that passes through such systems.
- Privacy
7.1. Tata Communications does not disclose any personal information about the customer that is collected during login process or during any special promotions carried out. This information will be used to understand the customer’s requirements and provide better services in future.
- Our liability towards the customer
8.1. Given the nature of telecommunication systems, particularly the Internet, we cannot guarantee that Tata Indicom Wi-Fi will always be available or will be error free.
8.2. Neither Tata Indicom nor any of it partners warrants that any software or other material accessed form any website using Tata Indicom Wi-Fi service is free of viruses, worms, Trojan horses or other harmful components.
8.3. The terms apply to the supply of Tata Indicom Wi-Fi Service are those that are expressly set out in this document.
8.4. We are not responsible for
8.4.1. loss caused by factors which could reasonably be considered to be beyond our control
8.4.2. any loss of data or loss of profits or revenue; and
8.4.3. any loss to the extent that it is caused by the customer, for example, through his negligence or breach of contract
8.5. Services may be suspended in whole or in part at any time without notice if the network requires urgent modification or maintenance. Tata Communications shall make all reasonable efforts to minimize the frequency and duration of such events.
8.6. If at anytime, during the continuance of Services, the performance in whole or part, of any obligation under it shall be prevented or delayed by reason of war, hostility, acts of the public enemy, civil commotion, sabotage, fire, flood, explosion, epidemic, quarantine restriction, strikes, lock-out or act of GOD etc., the customer shall not have any claim for damages against Tata Communications in respect of such non-performance or delay in performance of Service(s).
8.7. Tata Communications will not be liable for any problems encountered by the customer while using Wi-Fi services at any of Tata Indicom’s roaming partner’s site.
8.8. Tata Communications will not be liable for any billing related issues arising out of usage by customers of our roaming partners at any Tata Indicom hotspots.
- Changes to the landing page or website
9.1. Tata Communications reserves the right to make changes to the website or the landing page without informing the customer
- Termination
10.1. Customer may stop using Tata Indicom Wi-Fi at any time, for any reason.
10.2. We may immediately suspend, terminate or limit your access to Tata Indicom Wi-Fi service if:
10.2.1. We believe on reasonable grounds that there is a real risk of serious loss or damage to it or another if we do not suspend, terminate or limit your access to Tata Indicom Wi-Fi
10.2.2. The law requires us to do so
10.2.3. We believe on reasonable grounds that providing access to Tata Indicom Wi-Fi to you is illegal or may become illegal
- Use of customer information and material
11.1. When you send us any feedback, suggestions, ideas or other materials in relation to or via Tata Indicom
Wi-Fi, you agree that we can use, reproduce, publish, modify, adapt without restriction.
